Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Alto ("we," "us," or "our") governing your access to and use of the Alto website at www.altopages.com and the Alto document accessibility remediation platform (collectively, the "Service").

By creating an account, uploading documents, or otherwise using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

Alto is an AI-powered document accessibility remediation platform. The Service allows users to upload PDF documents and Microsoft Office files (Word, PowerPoint, Excel) for automated accessibility remediation. The Service includes, but is not limited to:

  • Automated PDF structure tagging (tag trees, marked content, headings, paragraphs, tables)
  • AI-generated alternative text for images
  • Optical character recognition (OCR) for scanned documents
  • Font embedding and repair
  • Document metadata remediation (title, language, XMP)
  • Form field tagging and tooltip generation
  • Conversion of Office files to accessible PDF format
  • Validation against PDF/UA-1 (ISO 14289-1) using veraPDF
  • Generation of conformance reports
  • Batch processing of multiple documents

3. Account Registration

To use the Service, you must create an account by providing a valid email address and password, or by authenticating through a supported third-party provider (such as Google). You agree to:

  • Provide accurate, current, and complete account information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Credits and Payment

4.1 Credit System

The Service operates on a credit-based system. One (1) credit equals one (1) page of document remediation. New accounts receive a one-time allocation of free credits. Additional credits may be purchased through the Service.

4.2 Credit Deduction

Credits are deducted at the time a remediation job begins, based on the page count of the uploaded document. If a job fails due to a system error, credits are automatically refunded. If a document is already compliant (as determined by our validation process), no credits are charged.

4.3 Pricing

Credit pricing is displayed on our pricing page and may change at any time. Price changes do not affect credits already purchased. All purchases are in US dollars unless otherwise specified.

4.4 Payment Processing

Payments are processed by Stripe, Inc. By making a purchase, you agree to Stripe's terms of service. We do not store your payment card information on our servers.

4.5 Refunds

Purchased credits are non-refundable except as required by applicable law. If you are unsatisfied with the Service, you may contact us within fourteen (14) days of purchase to request a refund of unused credits. Refund requests are evaluated on a case-by-case basis.

4.6 Credit Expiration

Purchased credits do not expire. Free credits provided at account creation do not expire.

5. Acceptable Use

You agree not to use the Service to:

  • Upload documents containing malware, viruses, or malicious code
  • Upload documents that you do not have the right to process
  • Attempt to circumvent credit limits, authentication, or security measures
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated scripts or bots to access the Service without our permission
  • Interfere with or disrupt the Service or servers
  • Use the Service for any unlawful purpose
  • Resell or redistribute the Service without our written consent
  • Upload documents that contain illegal content
  • Exceed reasonable usage limits that would degrade service for other users

We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated this section.

6. Intellectual Property

6.1 Your Content

You retain all ownership rights to documents you upload to the Service ("Your Content"). By uploading documents, you grant us a limited, non-exclusive license to process, store, and transmit Your Content solely for the purpose of providing the Service. This license terminates when you delete Your Content or your account.

6.2 Our Service

The Service, including its design, code, algorithms, and documentation, is owned by Alto and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

6.3 Remediated Output

You own the remediated (accessible) versions of your documents produced by the Service. The conformance reports generated for your documents are also yours to use, distribute, and share as needed for compliance purposes.

6.4 AI-Generated Content

Alt text and OCR text generated by AI as part of the remediation process are considered part of the remediated output and are owned by you. We do not claim any intellectual property rights over AI-generated descriptions embedded in your documents.

6.5 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, non-exclusive license to use that feedback for any purpose without compensation.

7. Document Processing Limitations

7.1 File Limits

The Service currently accepts individual files up to 50 MB in size and up to 200 pages per document. These limits may change. Files exceeding these limits will be rejected with an error message.

7.2 Supported Formats

The Service supports PDF documents and common Office formats including .docx, .doc, .pptx, .ppt, .xlsx, .xls, .odt, .odp, .ods, and .rtf. Office files are converted to PDF before remediation. Other formats are not supported.

7.3 Compliance Disclaimer

While Alto aims to produce documents that conform to PDF/UA-1 (ISO 14289-1), WCAG 2.1 Level AA, ADA Title II, and Section 508 requirements, we do not guarantee 100% compliance for every document. Remediation results depend on the complexity and quality of the input document. Some documents may require additional manual review, particularly those with:

  • Complex multi-column layouts
  • Heavily nested forms with non-standard field structures
  • Embedded multimedia or interactive content
  • Custom fonts with incomplete encoding tables
  • Encrypted or password-protected content (not supported)

The conformance reports we provide document the specific checks performed and their results. These reports are provided as evidence of remediation work performed, not as a legal certification of compliance.

7.4 Visual Appearance

The remediation process may make minor changes to the visual appearance of documents, particularly when font embedding or rebuilding is required. While we strive to preserve visual fidelity, the primary goal of remediation is accessibility, not pixel-perfect reproduction.

8. Availability and Support

8.1 Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

8.2 Support

Support is available via email at support@altopages.com. Response times vary based on your plan. Enterprise customers may receive priority support as specified in their service agreement.

8.3 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes. If a change materially reduces the functionality you have paid for, you may request a prorated refund of unused credits.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, we do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • Remediated documents will achieve full compliance with any particular standard
  • The AI-generated content (alt text, OCR) will be 100% accurate
  • The Service will be compatible with all document types and configurations

You acknowledge that document accessibility is a complex domain and that automated remediation, while effective for many common issues, may not address every accessibility barrier in every document.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Alto, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation: loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for all claims arising from or related to these Terms or the Service shall not exceed the total amount you have paid us in the twelve (12) months preceding the claim.

This limitation applies regardless of the theory of liability (whether contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

Specific limitation for compliance claims: Alto is not liable for any fines, penalties, legal fees, or damages arising from ADA, Section 508, WCAG, or other accessibility compliance actions, investigations, or lawsuits. The Service provides tools to assist with compliance, but the ultimate responsibility for regulatory compliance rests with you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Alto and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Documents you upload to the Service
  • Your reliance on remediated documents for compliance purposes

12. Termination

You may terminate your account at any time by contacting us at support@altopages.com. Upon termination:

  • Your access to the Service will be revoked
  • Unused credits are forfeited unless a refund is agreed upon
  • Your uploaded documents will be deleted within 30 days
  • Your account data will be deleted in accordance with our Privacy Policy

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or if required by law.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Government Users

If you are a U.S. government entity or using the Service on behalf of one, the Service is provided as "commercial computer software" and "commercial computer software documentation" as defined in 48 C.F.R. §2.101 and 48 C.F.R. §12.212. Use, duplication, and disclosure are subject to the restrictions in these Terms and applicable federal acquisition regulations.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Alto regarding the Service and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or the right to enforce it in the future.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

15.5 Notices

We may send notices to the email address associated with your account. You are responsible for keeping your email address current. Notices are deemed received 24 hours after being sent.

15.6 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
